Information you provide to us and how we use it
We collect the information from you as detailed below:
· To access certain areas of our Platform, you will need to register with us. During the registration process you will be asked to submit personal information about yourself (including your name and address, date of birth, e-mail address and telephone number). By entering your details in the fields requested, you enable Van Cleef & Arpels to provide you with the services you select;
· When you purchase products online or by phone, we collect information such as your purchase details and relevant payment information. In addition, we will also collect personal information from you when you correspond with us (for example, if you contact us with a query about one of our products or services), when you provide your details when you visit a Van Cleef & Arpels boutique or contact the Van Cleef & Arpels concierge by telephone. Please note that phone calls will on occasion be recorded for security, training and development purposes;
· If you choose to interact with Van Cleef & Arpels via a social media platform or other third party service, we will collect the information you have provided to us through that platform;
· We also collect certain information automatically about visitors to our Platform, described in the section headed "Cookies and other information that we automatically collect", below; and
· We will collect information about your location to the extent that we provide any location services, described in the section headed “Location services” below.
We will use the information we collect from you to:
· Manage and fulfil purchase and repair orders, facilitate delivery, and to provide after-sales services;
· Deal with your enquiries and requests;
· Send service related communications, including announcements and administrative messages such as order confirmation;
· Send you marketing communications (including e-mails and social media audience matching) relating to us and other third party partners and that we think may be of interest to you where we have a legitimate basis to do so (please see the “Your choices” section below for further information about how you can control these updates);
· Conduct market research so that we can continuously improve the services we provide to our customers;
· Undertake credit checking, prevention of fraud and other prohibited or illegal activities as part of our efforts to keep our Platform and services secure; and
· Understand how our Platform is used so that we can continuously improve our Platform and services and other offerings.

Van Cleef & Arpels has created its various Platforms to provide information about its company and products for your personal use. CONDITIONS OF SALE VAN CLEEF & ARPELS CHINA E-BOUTIQUE AND CLIENT RELATIONS CENTRE
The following terms and conditions and any other related rules that are adopted by Van Cleef & Arpels and made available as provided herein (collectively the “Conditions of Sale”) shall apply to all sales of Van Cleef & Arpels products that you (the “Customer” or “you”) may order from
历峰贸易（上海）有限公司(Richemont Trading (Shanghai) Co., Ltd), a corporation organised and existing under the laws of the People’s Republic of China and having a place of business at Unit 801-808, 8/F, Tower 3, Kerry Center, 1288 Yan An Road Middle, JingAn district, Shanghai. 200041 (“Van Cleef & Arpels” or referred to herein as “us”, “our” or “we”) either (a) by phone via the customer contact centre of Van Cleef & Arpels (the “Client Relations Centre”), whose telephone number and email address are indicated on the Website or (b) on the Internet via Van Cleef & Arpels’s Website, identified by the domain name "www.vancleefarpels.com" (the "Website").
These Conditions of Sale apply exclusively to sales made through the Client Relations Centre or the Website. Sales conducted through Van Cleef & Arpels retail boutiques, Van Cleef & Arpels shop-in-shops or authorised Van Cleef & Arpels dealers are not subject to these Conditions of Sale.
Van Cleef & Arpels may modify the Conditions of Sale from time to time, at its sole discretion. The Conditions of Sale applicable to any order placed through the Client Relations Centre or the Website are those in force at the time that an order is placed on the Website or through the Client Relations Centre. If you refuse to accept these Conditions of Sale, you will not be able to order any Van Cleef & Arpels products from the Website or the Client Relations Centre.
2. PURCHASING ELIGIBILITY
Only individuals who (a) have reached the age of majority (eighteen years old), (b) have legal capacity to enter into contracts and (c) are living in the People’s Republic of China (excluding the Hong Kong and Macau Special Administrative Regions) may order products through the Client Relations Centre or on the Website. If you are under the age of majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and thereby assent to these Conditions of Sale. Any orders placed in contravention to this provision shall be null and void.
By placing an order through the Client Relations Centre or on the Website, you represent and warrant that you are a bona fide end-user Customer and will not deliver, sell or otherwise distribute Van Cleef & Arpels products or purchase Van Cleef & Arpels products for commercial purposes or any other commercial benefit.
3. PRODUCT AVAILABILITY - QUANTITY
All orders placed through the Client Relations Centre or on the Website are subject to availability and acceptance by Van Cleef & Arpels. If despite our efforts the product is no longer available or Van Cleef & Arpels believes, for legitimate grounds, that an order would violate these Conditions of Sale, Van Cleef & Arpels may refuse such order.
Van Cleef & Arpels reserves the right to change the assortment of products proposed on the Website or through the Client Relations Centre and may limit from time to time the quantity of Van Cleef & Arpels products that may be ordered by a Customer in a single buying session. Each Order may not exceed five (5) different references and one (1) products of the same reference in any buying session.
The Client Relations Centre and the product pages of the Website can provide you with information regarding products that are currently available for sale through these channels.
4. ACCOUNT REGISTRATION - PERSONAL INFORMATION
In order to place an order through the Client Relations Centre or on the Website, you or the Van Cleef & Arpels representative (on your behalf) will have to create your Van Cleef & Arpels online account unless you select the "Guest Checkout", or the “Sina Weibo mutual login” on our Website.
If you select the “Guest Checkout” you will have later the possibility to create your Van Cleef & Arpels online account upon receiving the Order Acknowlegement. Please note that in such case, your Van Cleef & Arpels online account will not include transactions made prior to the creation of your account.
Creating a Van Cleef & Arpels online account will enable you to save your wish list and access the history of your transactions from the date of creation of your account.
In order to create your Van Cleef & Arpels online account, you will be required to provide valid and up-to-date personal information, such as your legal name, phone number and e-mail address, and to confirm that you have reached the age of majority.
Upon creation of your Van Cleef & Arpels online account, you will receive an e-mail which will allow you to log in to your account on the Website and create a permanent account login and password. You may also receive a second e-mail summarising the personal information you provided in registering for your Van Cleef & Arpels online account.
You are responsible for ensuring that your password and account login are kept secret, safe and secure at all times. Van Cleef & Arpels will not be held responsible or liable for any misuse of your account resulting from a third party’s access to and use of your password and account login. Moreover, in the event that Van Cleef & Arpels reasonably suspects that a third party has breached a Customer's registration, password and/or Van Cleef & Arpels account login, Van Cleef & Arpels will cancel and terminate such account, and notify the Customer by e-mail or telephone.
The display of products on the Website constitutes no offer, but only an invitation to you to submit an offer to Van Cleef & Arpels. By placing your order, you submit an offer to us for the purchase of the chosen product(s). This offer will then be processed by us according to the following provisions.
If you are ordering a product that is available on the Website, once you have chosen a product, place this product in your “shopping bag”. You may then decide to continue shopping for other products and add them to your shopping bag (subject to availability and quantity limits) or place your order by proceeding to checkout. You may also remove from the shopping bag one or several products you have selected.
When ordering by telephone through the Client Relations Centre (telephone number indicated on the Website), a Van Cleef & Arpels representative will follow the order process on your behalf.
Notwithstanding anything to the contrary provided for herein, Van Cleef & Arpels reserves the right to refuse, cancel and terminate orders at any moment in time for legitimate grounds. For example, Van Cleef & Arpels may refuse, terminate or cancel your order if there is an on-going dispute concerning payment of a prior order or if Van Cleef & Arpels suspects that you have violated these Conditions of Sale. Van Cleef & Arpels also reserves the right to withhold or refuse acceptance of any order for products accompanied by a personal message that contains language that is objectionable or unlawful.
6. PRICES, TAX AND SHIPPING COSTS
All prices shown on the product pages of the Website or quoted by the Client Relations Centre are in Renminbi (CNY) including VAT, but excluding shipping costs and other taxes unless otherwise stated.
Van Cleef & Arpels reserves the right to modify prices and delivery costs at any time without prior notice, such change applying to orders placed through the Client Relations Centre or on the Website after this modification.
Shipping costs are not stated on the product pages but will be added to the product price before you place your order.
Shipping costs, if any, are described in the shipping policy set forth below or on the Website. Van Cleef & Arpels bears the shipping costs for customer’s orders.
7. ORDER REVIEW AND CONFIRMATION BY CUSTOMER
Our Website ordering process allows you to check your order, and correct any errors, before submitting it to Van Cleef & Arpels.
You should carefully check all details before placing your order through the Client Relations Centre or on the Website, including without limitation the particulars of each sale, which will be provided in an order summary on the Website or by the Van Cleef & Arpels representative if you place your order through the Client Relations Centre.
When you have completely reviewed your order, you will have the opportunity to review the Conditions of Sale posted on the Website, and you will need to accept to be bound by them in order to place your order.
Your billing address must be in the People’s Republic of China (excluding the Hong Kong and Macau Special Administrative Regions). International cards with a foreign billing address will not be accepted.
8.1. Payment through third party service provider
Van Cleef & Arpels will provide you by email, in the Order Acknowledgment, with a link to its third party payment providers’ websites (such as Alipay and ICBC) for you to make payment of the full amount mentioned in this email.
You shall proceed to these third party payment providers’ websites to make payment of the full amount mentioned in the Order Acknowledgment.
You will have the option to pay using credit card, debit card and bank transfer options, as provided on these third party payment providers’ websites.
Your payment must be credited on our bank account within twenty-four (24) hours after you have placed your order, otherwise it will be automatically cancelled.
All payment methods are subject to validation checks and authorisation by our third party payment provider. If the third party payment provider refuses to authorise your payment to Van Cleef & Arpels, Van Cleef & Arpels will not process the order.
When paying on these third party payment providers’ websites, you will be subject to their terms and policies.
8.2. Payment by direct bank transfer to Van Cleef & Arpels
You will be given the possibility to pay by bank wire transfer.
After you place an order and select bank wire transfer as your method of payment, Van Cleef & Arpels will provide you by email, in the Order Acknowledgment, with its bank account details and wait until your payment is received before processing your order.
If your payment is not credited into our bank account within seventy-two (72) hours after you have placed your order, it will be automatically cancelled.
Please do not forget to mention the Order Reference Number in your bank wire transfer form.
8.3. Payment by cash-on-delivery
For orders below 20,000 RMB, customers registered on the Website will also have the possibility to pay upon receipt of the product, as indicated on the Website or through the Client Relations Centre.
Please note that specific rules apply to cash-on-delivery. If you chose cash-on-delivery, you will not be able to request Van Cleef & Arpels to personalize or engrave your product and may only modify or cancel your order before it is processed by Van Cleef & Arpels.
If you pay by cash-on-delivery, Van Cleef & Arpels, or its third party delivery provider, will hand over the products to you only after full payment of your order.
If you have used cash-on-delivery, any refund will be completed by Van Cleef & Arpels on the bank account you have mentioned on the return form or on the payment card you have indicated to the Client Relations Centre, or as otherwise provided on the Website.
Van Cleef & Arpels takes precautions to safeguard your personal information against loss, theft, and misuse, as well as against unauthorised access, disclosure, alteration, and destruction. Van Cleef & Arpels uses Secure Sockets Layer (SSL) encryption on all web pages where personal information is collected.
9. ORDER ACKNOWLEDGMENT
Once you have placed your order on the Website or through the Client Relations Centre, you will receive by e-mail an Order Acknowledgment mentioning the details of your order along with instructions or a link regarding the selected payment method and these Conditions of Sale. This Order Acknowledgment will contain an Order Reference Number assigned by Van Cleef & Arpels.
This Order Acknowledgment is not an acceptance of your order by Van Cleef & Arpels.
Without prejudice to your other rights mentioned in these Conditions of Sale, you may call the Client Relations Centre to modify your order before payment or to cancel it before shipment, but not afterwards.
10. ORDER CONFIRMATION
Following receipt by Van Cleef & Arpels of your payment (through our third party service providers, by direct bank transfer or cash-on-delivery), we will send you by email an Order Confirmation notifying you that your order has been accepted by Van Cleef & Arpels.
The Order Confirmation confirms the acceptance of your order by Van Cleef & Arpels and the existence of a binding sales contract.
Van Cleef & Arpels will preserve information concerning all orders as required by applicable law. These records may be made available to the Customer either by registering on the Van Cleef & Arpels online account section of the Website or by contacting the Client Relations Centre.
11. ORDER SHIPMENT
Upon shipment of the product you have ordered, Van Cleef & Arpels will inform you by e-mail.
12. SHIPPING POLICY
When placing your order on the Website or through the Client Relations Centre you will be asked to provide the shipping address.
Boutique pick-up may be offered, free of charge, to certain locations. Please refer to the Website or call the Client Relations Centre for more information.
Please note that Van Cleef & Arpels accepts orders for delivery to most of the main areas within the People’s Republic of China, except to the Hong Kong and Macau Special Administrative Regions and certain addresses, such as PO boxes, military areas or hotels.
If you order several products, Van Cleef & Arpels will ship the order only once all products are available (no partial shipments).
Please refer to the Website or call the Client Relations Centre for more information about delivery cities, shipping costs and estimated delivery lead times.
Delivery costs, if any, will be added to the price of the Van Cleef & Arpels products themselves.
The delivery costs and the estimated delivery lead times will be summarised in the Order Acknowledgment.
We will use commercially reasonable efforts to ensure the delivery by our third party shipping provider within the estimated delivery lead time mentioned in the Order Acknowledgment.
When estimating the delivery lead time, please note that it is always subject to receiving your full payment (save for sales by cash-on-delivery).
Each delivery package will contain, in addition to your purchased Van Cleef & Arpels product: (i) all related accessories, if any, (ii) the document holder including the Product Manual, as applicable, and the Certificate of Authenticity and Warranty Card; (iii) a thank you letter and a blank message card for gifts, and (iv) the delivery slip that indicates the Order Reference Number.;(v) the conditions of sale and the return form.
The tracking number of your shipment will be available for registered users through the “My Account” section of Website or via the Client Relations Centre. This tracking number will also be added to the order shipment email.
We will require a signature by you or an adult acting on your behalf to confirm the delivery of each Van Cleef & Arpels product, at which point responsibility for your purchased goods passes to you.
When ordering products on the Website or through the Client Relations Centre, you will receive: (a) a Van Cleef & Arpels invoice and (b) the Government general FAPIAO.
If you wish to receive a VAT refundable FAPIAO you must contact the Client Relations Centre, follow its procedures and provide the necessary documentation indicating that you purchased the products via your company account.
14. RETURN POLICY
14.1. Consumers’ right of return for refund
As a consumer based in the People’s Republic of China, you have the right to return a product ordered on the Website or through the Client Relations Centre, for refund, within seven (7) days from the date of receipt of the product.
To exercise your right of return, you must call our Client Relations Centre (telephone number indicated on the Website) to obtain by email a return form mentioning the Return Number (RN) and send back the product to the Van Cleef & Arpels Returns Department by following the return process set forth in Clause 14.2.
If you exercise your right of return, we will refund to the original buyer (and not to the gift receiver, in case of a gift) the price of the product paid by the original buyer, within seven (7) days from the date of receipt by Van Cleef & Arpels of the returned product, provided that the returned product has satisfactorily passed our Quality Control.
We will carry out such reimbursement to the original buyer only and using the same means of payment as used by the original buyer for the initial transaction. If you have used cash-on-delivery to pay for your order, please provide your bank account information on the return form or call our Client Relations Centre to provide your card details, for Van Cleef & Arpels to be able to refund the price of your product.
14.2. Return process
Products that have been purchased on the Website or through the Client Relations Centre may only be returned to the address of the Van Cleef & Arpels Returns Department, as provided by the Van Cleef & Arpels Client Relations Centre, in accordance with these Conditions of Sale.
Products that have been purchased on the Website or through the Client Relations Centre may NOT be returned to a Van Cleef & Arpels boutique.
Products that have NOT been purchased on the Website or through the Client Relations Centre may NOT be returned to Van Cleef & Arpels pursuant to these Conditions of Sale.
If you decide to return a product, please send it back without undue delay and in any event no later than seven (7) days after the receipt of the product.
To return a product you must follow the steps mentioned below.
First, please call the Client Relations Centre (telephone number indicated on the Website) to obtain by email the address of the Van Cleef & Arpels Returns Department and the form mentioning the Return Number (RN).
i) Fill out the required information on the return form and sign it,
ii) Include the completed return form with the product, all its accessories, the Product Manual, the Certificate of Authenticity, the Warranty Card, invoices and all other documents, in its original box and delivery package,
iii) Please also include the Fapiao with our company's name indicated (Richemont Trading (Shanghai) Co., Ltd) or the Fapiao with fixed amount,
iv) Seal the delivery package,
v) Send back the package to the address of the Van Cleef & Arpels Returns Department provided by the Client Relations Centre.
We advise you to use FedEX. Our Client Relations Centre will organize, at our own costs, the FedEx pick up of the goods to be returned upon your confirmation. If you wish to return a Van Cleef & Arpels product by other means, you must bear the shipping expenses for the returned goods, and if the product appears during Quality Control (QC) to have defects caused by Van Cleef & Arpels we will reimburse you these return shipping expenses subject to you providing our Client Relations Centre with the FAPIAO indicating our company’s name or the FAPIAO with fixed amount.
You must keep a proof of shipment. Van Cleef & Arpels accepts no liability in the event that such proof cannot be produced. Only products received by the Van Cleef & Arpels Returns Department will be eligible for a refund, in accordance with these Conditions of Sale.
Upon receiving a return, Van Cleef & Arpels will verify that the returned product complies with these Conditions of Sale.
14.3. Return conditions
Van Cleef & Arpels products must be returned in a new and unused state.
Personalised Van Cleef & Arpels products cannot be returned to Van Cleef & Arpels.
Watch bracelets that have been adjusted at the Customer’s request must be returned with the exact same number of links as in the original delivery package.
Please also return the original Van Cleef & Arpels box and delivery package, including all accessories and documents.
All returns will be subject to strict Quality Control (QC) by Van Cleef & Arpels to ensure that the returned products satisfy these requirements.
Only if the returned product satisfies Quality Control (QC), will Van Cleef & Arpels proceed with the refund.
Failure to comply with the return process above or the return conditions will entitle Van Cleef & Arpels to refuse the returned product and send it back to the consumer, at the consumer’s own cost.
14.4. Customers’ exchanges
Customers may exchange a product purchased on the Website or through the Client Relations Centre for another Van Cleef & Arpels product of same value, provided that the product to be exchanged complies with these Conditions of Sale.
In any event, the sale of the returned product will be cancelled and a new order for the product ordered in exchange will be created.
15. MANUFACTURER'S GUARANTEE
Van Cleef & Arpels is extremely cautious in ensuring that each product strictly complies with its quality criteria and that it has passed all controls, both technical and aesthetic.
Selected products are covered by the Van Cleef & Arpels International Guarantee. To ask for repairing a product covered by the Van Cleef & Arpels International Guarantee, please refer to the Service Guide for more information.
16. LEGAL GUARANTEE
In your capacity as consumer, you may have legal rights under applicable national legislation governing the sale of consumer goods or defective products; especially with respect to clocks and watches as provided in the Catalogue of the Goods to which Guaranteed Repair, Exchange and Return Rules shall apply, and with respect to other products as specifically provided in Article 24 of the Consumer Rights Protection Law. Those legal rights are not affected by these Conditions of Sale.

18. ACCURACY OF PRICING, PRODUCT DESCRIPTIONS
While Van Cleef & Arpels endeavours to verify the accuracy of any information it places on the Website, in advertisements or catalogues or as provided by the Client Relations Centre, it makes no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. Van Cleef & Arpels does not confirm the price of a Van Cleef & Arpels product until an Order Confirmation has been issued by Van Cleef & Arpels, indicating the existence of a binding sales contract. If a Van Cleef & Arpels product’s correct price is higher than the price posted on our Website, then Van Cleef & Arpels will either contact the Customer for instructions before shipping the order or, if Van Cleef & Arpels cannot obtain your instructions, reject the order and notify you of such rejection.
While every effort will be made to ensure that the descriptions, photographs or graphical representations of the Van Cleef & Arpels products displayed on the website or in a catalogue are as accurate as possible, Van Cleef & Arpels does not warrant that such materials or other content is error-free, whether as a result of inaccuracy, omission, obsolescence or otherwise. Accordingly, the Customer’s sole remedy in the event of any such error is to return the product as set forth in our return policy.
19. FINAL PROVISIONS

Severability. In the event that any provision of the Conditions of Sale shall be determined to be partially void or unenforceable by any court having jurisdiction and for any reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the Conditions of Sale shall not be affected.
20. GOVERNING LAW
These Conditions of Sale shall be governed by and construed in accordance with the laws of the People’s Republic of China.
The courts of Shanghai will adjudicate any disputes in relation to these Conditions of Sale.
Without any restriction to bring proceedings before a court, Van Cleef & Arpels or the Customer will first make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any breach thereof.
